At approximately 1:30 a. m. on January 6, 1964, the Van Ess Sportsmans Bar in Green Bay, Wisconsin, was burglarized. The appellant, Alvin Van Beek, was observed by a patrolman inside the tavern after the time of closing. In addition, there was circumstantial evidence which cast suspicion on the appellant, and on March 10, 1964, following a jury trial, the appellant was convicted of burglary in violation of sec. 943.10 (1) (a), Stats. He was sentenced on March 16, 1964, to a term of not more than ten years' imprisonment. Mr. Van Beek did not move the trial court for a new trial or to set aside the verdict on the ground of insufficient evidence.
